Courts are acknowledging a shifting consumer preference toward electronic mediums. Proposed changes to Rule 23, scheduled to take effect on Dec. 1, 2018, will officially provide for the use of electronic notice in class actions. The new changes expressly recognize that notification by electronic means, such as by email, is an acceptable method to notice potential class members. The change could save parties a significant amount of money that previously would have been spent on printing and postage costs. Additionally, email notice provides an opportunity for parties to direct class members to the settlement website via a convenient, clickable link, potentially stimulating claims submissions measurably.
